CASE STUDIES: COMMERCIAL DISPUTES
Business Interruption Losses
A manufacturing company’s operations were unexpectedly interrupted when the equipment that brought electricity into the plant failed. The manufacturing company filed a claim against the equipment supplier for lost profits incurred as a result of the plant shutdown. ValuePoint was retained by the equipment supplier’s law firm to determine the manufacturing company’s actual lost profits and assist with negotiating a settlement.

The ValuePoint professionals working on this assignment were able to secure the cooperation of key employees from the manufacturing company and gain a thorough understanding of their operations. We prepared a “but for” analysis that determined the Company’s losses were substantially mitigated.  As a result, we were able to assist our client with negotiating a favorable settlement without jeopardizing the business relationship between the two companies.
